Nebraska Child Custody Laws
Custody will be awarded based upon the best interests of the child. In determining best interests, the Court will consider the following factors:
-
the general health, welfare, and social behavior of the child;
-
the preference of the child, if the child is of sufficient age and capacity;
-
the child's relationship with each parent prior to the filing for dissolution of marriage; and
-
any credible evidence of child or spousal abuse.
Joint custody may be awarded if both parents agree that such an arrangement would be in the childs best interests.
